Terms of Service

OVERVIEW

This website is operated by Black Sisters Birth Academy® (BSBA), a division of Black Sisters Midwifery Services, PLLC. Throughout the site, the terms “we,” “us,” and “our” refer to Black Sisters Birth Academy®. By visiting our site or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

 

SECTION 1 - MEDICAL & SCOPE OF PRACTICE DISCLAIMER

1.1 Educational Purpose Only: All content, modules, and training provided by BSBA are for educational purposes only and do not constitute professional medical advice, diagnosis, or treatment.

 

1.2 No Licensure or Collaborative Agreement: Certification identifies you as an assistant-level professional. It does not grant medical licensure or authorize the independent clinical practice of midwifery. BSBA does not provide clinical supervision or "Collaborative Agreements" for independent student practice.

 

1.3 NARM & Midwifery School Disclaimers: Black Sisters Birth Academy® is a birth assistant certification program only. We are not a midwifery school, and our curriculum is not a substitute for a NARM-approved midwifery program. Students are solely responsible for verifying if any part of this training satisfies requirements for their specific midwifery school or NARM PEP route. BSBA does not manage, sign, or provide oversight for NARM clinical logs or midwifery student documentation. 

 

1.4 Supervision Required: Use of this site does not establish a midwife-patient relationship. You explicitly agree to perform clinical tasks ONLY under the direct supervision and licensure of a primary Midwife and in compliance with your specific state jurisdiction.

 

SECTION 2 - REVENUE PROTECTION (NO REFUNDS & NO CHARGEBACKS)

2.1 Strict No-Refund Policy: All sales of digital products, training fees, and enrollment costs are final and non-refundable. Due to the proprietary nature of our curriculum and immediate delivery of intellectual property, no exceptions will be made.

 

2.2 Payment Plans: Choosing a payment plan does not waive your obligation to pay the full tuition. If you withdraw or fail to pay, the remaining balance becomes due immediately.

 

2.3 Chargeback Prohibition: We maintain a strict no-chargeback policy. Initiating a payment dispute with a financial institution will result in the immediate and permanent revocation of program access and certification eligibility without a refund.

 

SECTION 3 - INTELLECTUAL PROPERTY & PROHIBITED USES

3.1 Ownership: BSBA and its licensors own all rights, titles, and interests in the Services, including the Blueprint for Clinical Excellence, manuals, scripts, and video modules.

 

3.2 Prohibited Acts: You are prohibited from reproducing, duplicating, or exploiting any portion of our Intellectual Property to create competing trainings or services. We reserve the right to terminate service for any infringement or brand disparagement.

 

SECTION 4 - BINDING ARBITRATION & CLASS ACTION WAIVER

4.1 Mandatory Arbitration: ANY DISPUTE RELATING TO YOUR PURCHASE WILL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION ADMINISTERED BY THE AAA. YOU AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY.

 

4.2 Individual Basis Only: YOU AGREE TO GIVE UP ANY RIGHTS TO PARTICIPATE IN A CLASS ACTION. Arbitration shall be conducted on an individual basis only.

 

SECTION 5 - INDEMNITY & LIMITATION OF LIABILITY

5.1 Indemnification: You agree to indemnify and hold harmless BSBA and its directors (including Christina Jemine) from any claims, losses, or damages arising out of your use of the Service or your professional and clinical conduct at any bedside or supervised clinical site.

 

5.2 Assumption of Risk: You expressly and specifically assume the risk of injury, illness, or death resulting from your activities as a birth worker and release BSBA from all liability.

 

5.3 Liability Cap: OUR ENTIRE MAXIMUM LIABILITY SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS AND SERVICES ORDERED THROUGH OUR SITE.

 

SECTION 6 - PROGRAM EXPIRATION & RECORD RETENTION

6.1 Access Window: Standard program access is 6 months (180 days). Failure to complete within this window results in account deletion.

 

6.2 Extensions: A one-time 3-month extension is available for a $300 USD fee, which must be requested before your original expiration date.

 

6.3 Record Retention: BSBA maintains digital records for five (5) years. Replacement requests within this window are subject to a $15 Administrative Fee.

 

SECTION 7 - PROFESSIONAL STANDING & DIRECTORY POLICY

7.1 Recertification: To maintain "Active" status in the National Birth Assistant Directory, graduates must recertify every two (2) years.

 

7.2 B2B/Referral Safeguard: Black Sisters Birth Academy® is an educational institution, not an employment agency. While we facilitate connections through our Directory, we do not guarantee, broker, or provide oversight for employment or independent contracts.

 

7.3 Endorsements: Letters of recommendation and professional endorsements are a courtesy reserved for Hybrid/In-Person Graduates only.

 

SECTION 8 - GOVERNING LAW

8.1 Jurisdiction: These Terms shall be governed by the laws of the State of Florida. By using this site, you agree to the exclusive jurisdiction of the County of Martin, State of Florida.

 

SECTION 9 - MARKETING & LIKENESS

9.1 Media Release: You grant BSBA the right to use your image, likeness, and feedback (from virtual or in-person sessions) for marketing purposes without further compensation.

 

SECTION 10 - THIRD-PARTY LINKS & AFFILIATES

10.1 Affiliate Disclosure: BSBA may have a monetary relationship with recommended third-party services (e.g., NRP/CPR providers). We only recommend services that meet our Clinical Standard for Excellence.

 

SECTION 11 - FORCE MAJEURE

11.1 Excusable Delays: BSBA shall have no liability to you under this agreement if it is prevented from or delayed in performing its obligations by acts beyond its reasonable control, including: strikes, failure of a utility or telecommunications network, acts of God, war, riot, accident, fire, flood, or storm.

 

SECTION 12 - THIRD-PARTY DATA PROCESSORS

12.1 Service Infrastructure: We use high-level platforms to provide our Academy services, including Wix, Thinkific, and Flodesk.

 

12.2 Secure Payment Processing: All financial transactions are handled by PCI-compliant processors, including Stripe and PayPal. By using our Service, you acknowledge that your data will be stored on the secure servers of these providers.

 

SECTION 13 - META ADVERTISING & LEAD GENERATION

13.1 Meta Business Tools: We utilize Meta Pixels and Meta Lead Forms. Submission of your info via these forms constitutes consent to our processing. Meta and other third parties may use cookies and pixels to collect information for measurement services and targeted ads.

CLINICAL TRAINING DISCLAIMER & SCOPE OF PRACTICE

These learning programs and courses are intended for educational and training purposes only and are provided as a professional service by Black Sisters Birth Academy®, a division of Black Sisters Midwifery Services, PLLC. Certification as a Birth Assistant through this Academy does not grant medical licensure, confer clinical privileges, or authorize the independent clinical practice of midwifery. Graduates operate strictly as non-autonomous assistants under the direct supervision and legal jurisdiction of a licensed, certified, or traditional midwife practicing legally within their respective jurisdiction. In no event shall Black Sisters Birth Academy® or its affiliates be liable for any claims, liabilities, or damages resulting from the application of these educational materials. Individual professional outcomes depend entirely on student commitment, prerequisite verification, and the successful completion of all curriculum requirements.
